1) Who We Are

“TheBrandZee,” “we,” “us,” and “our” refer to thebrandzee, operating digital services including AI Search Engine Optimization, marketing automation (n8n & GoHighLevel), and training/courses via our websites and subdomains (the “Services”).

2) Acceptance of Terms

By accessing or using the Services, purchasing any plan/course, or engaging us via proposal, you agree to these Terms. If you do not agree, please do not use the Services.

3) Services Overview

We provide:

  1. (a) AI-driven SEO strategy and implementation
  2. (b) automation design and deployment using n8n and/or GoHighLevel
  3. (c) courses, workshops, and digital downloads
  4. (d) related consulting and support. Specific scope, timelines, and pricing are defined in a written Proposal/SOW or the product page at checkout.

4) Ordering, Proposals & Scope Changes

4.1 An order is formed when you (i) accept a written proposal/SOW, or (ii) complete checkout on our website. 
4.2 Scope changes require mutual written agreement and may affect price and timelines. 
4.3 We may refuse or cancel orders at our discretion (e.g., compliance risks, non-payment).

5) Pricing, Taxes & Payments

5.1 Prices are listed in the checkout/proposal and may change without notice until an order is placed. 
5.2 Payments are processed via WooCommerce and gateways such as PayFast. We do not store full card details.
5.3 Prices may be exclusive of applicable taxes; you’re responsible for all taxes, duties, or bank fees.
5.4 Late or failed payments may pause or terminate Services.

6) Client Responsibilities

You will:

  1. (a) provide accurate information
  2. (b) supply required access (e.g., analytics, CMS, CRM, APIs) and approvals promptly
  3. (c) ensure you have rights to any assets you provide
  4. (d) comply with applicable laws and platform policies.

7) Intellectual Property & License

7.1 Your Materials: You retain ownership of assets you supply. You grant us a limited license to use them to deliver the Services. 
7.2 Deliverables: Upon full payment, we grant you a non-exclusive license to use final deliverables for your business. Our pre-existing tools, libraries, and templates remain our IP; we grant you a license to use them with the delivered project.
7.3 Portfolio Use: We may display non-confidential work results (before/after, case notes) in our portfolio unless you object in writing.

8) AI, Data & Third-Party Tools

8.1 We may use AI models, automation platforms (n8n, GoHighLevel), analytics, and other processors.
8.2 You are responsible for third-party subscription fees you request us to integrate (e.g., GHL seat, APIs).
8.3 Use of processors is governed by their own terms; we are not liable for their outages or policy changes.

9) Confidentiality & Data Protection

Each party will keep confidential information secret and use it only for the project. Personal data is handled per our Privacy Policy. You are responsible for revoking any temporary credentials after project completion.

10) Timelines, Revisions & Acceptance

10.1 Timelines are estimates and depend on your responsiveness.
10.2 Unless otherwise stated, one (1) round of reasonable revisions is included for each major deliverable within 7 days of delivery.
10.3 A deliverable is deemed accepted when you approve it in writing or 7 days elapse without change requests.

11) Warranties & Disclaimers

11.1 We provide Services with reasonable skill and care. 
11.2 We do not guarantee specific rankings, traffic, revenue, ad performance, or platform approvals, as these depend on external factors.
11.3 Except as stated, Services are provided “as is” without warranties of merchantability, fitness, or non-infringement.

12) Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim will not exceed the fees you paid for the Service giving rise to the claim in the 3 months preceding the event. We are not liable for indirect, incidental, consequential, or special damages (including lost profits or data).

13) Indemnity

You agree to indemnify and hold us harmless from claims arising from

  • (a) your materials
  • (b) unlawful or infringing instructions
  • (c) misuse of the Services
  • (d) regulatory breaches attributable to your business practices.

14) Termination & Suspension

Either party may terminate for material breach if not cured within 10 days of written notice. We may suspend Services for non-payment, suspected abuse, or security risks. On termination, accrued fees remain due. Refunds follow the Return/Refund Policy.

15) Force Majeure

We are not responsible for delays/failures caused by events beyond reasonable control (e.g., outages, cyber incidents, regulatory changes, natural disasters).

16) Governing Law & Disputes

These Terms are governed by the laws of Pakistan. Courts/tribunals in Karachi, Pakistan shall have exclusive jurisdiction. You agree to first attempt good-faith resolution before formal proceedings.

17) Changes to Terms

We may update these Terms at any time. Updates become effective upon posting with a new “Last updated” date.

Nature of Delivery

We provide digital services and products. No physical shipping is involved. Delivery occurs through:

  • Email, shared drives, or project workspaces

  • Access to CRM/automation (n8n, GoHighLevel) as configured

  • Course/LMS login credentials and content access

  • Website/CMS deployments or secure handover files

Processing & Delivery Times

  • Service Projects: Discovery/kickoff within 2–5 business days after payment and intake. Deliverables follow the timeline in your proposal/SOW.

  • Automations (n8n/GHL): Initial setup typically within 3–10 business days post-access; exact milestones in the SOW.

  • Courses/Digital Products: Access is usually granted within minutes of successful payment; allow up to 24 hours in rare cases. \n

  • Time Zone: All timelines are based on Asia/Karachi (PKT) business hours.

Communication & Support

  • Support Hours: Mon–Fri, 10:00–18:00 PKT (excluding public holidays).

  • Response SLAs: New tickets 1–2 business days; active project queries same/next business day.

  • Channels: Email (thebrandzeeofficial@gmail.com). Project boards or chat may be used if agreed.

File Formats & Access

We deliver in mutually agreed formats (e.g., Google Docs, CSV, MP4, JSON, ZIP). Admin access to your platforms (e.g., GHL sub-account) is configured per SOW. You are responsible for maintaining your own backups after handover.

Delays & Dependencies

Client delays in approvals, content, or access can shift timelines. Third-party outages (hosting, CRMs, APIs, payment gateways) may also affect delivery. We will notify you and adjust plans where possible.

Acceptance & Handover

Deliverables are considered accepted upon written approval or after 7 days without revision requests. Credentials provided for setup should be rotated by you after completion.

Services (AI SEO, Automation, Consulting, etc.)

  • Deposits/Upfront Fees: Non-refundable once the project is scheduled and kickoff materials are shared.

  • In-Progress Work: Fees for completed milestones are non-refundable. If you cancel mid-project, you remain liable for work completed or committed resources.

  • Performance Disclaimer: Because outcomes depend on external platforms and market conditions, results are not guaranteed and are not grounds for refunds.

Courses & Digital Products

  • Self-Paced Courses / Digital Downloads: Due to immediate access, these are generally non-refundable.

  • Exception (optional—edit if you want to offer): 7-day refund if (a) under 20% of course content is consumed, (b) no downloadable assets have been saved, and (c) a brief reason is provided so we can improve. Abuse of policy or excessive usage voids eligibility.

Failed Delivery / Access Issues

If you do not receive course access or files within 72 hours of payment, contact thebrandzeeofficial@gmail.com with proof of purchase. Once verified, we will re-provision access or issue a refund if we cannot fulfill within a reasonable period.

Automation/Integration Constraints

Refunds are not issued for limitations imposed by third-party tools (e.g., GHL policy changes, API limits, ad account restrictions). We will propose viable alternatives or scope adjustments where possible.

How to Request a Refund

Email thebrandzeeofficial@gmail.com with: (a) order number, (b) purchase email, (c) product/service name, (d) reason for request, and (e) any relevant screenshots. We typically respond within 2 business days and resolve within 7–14 business days after verification.

Chargebacks

Please contact us to resolve issues before initiating a chargeback. Unauthorized or fraudulent chargebacks may be contested with your payment provider using our logs and delivery records.

Changes to This Policy

We may update this policy as needed; updates apply to future purchases and, where lawful, to ongoing subscriptions with notice.
